FOR RECORD ONLY $//PN,PETITION TO DENY AGAINST BROADBAND PCS A AND B,DA 95-1170//$ $/ 1.1208 Restricted proceedings/$ May 26, 1995 PETITION TO DENY AGAINST BROADBAND PCS A AND B BLOCK APPLICANTS AND RELATED REQUESTS TO STAY A AND B BLOCK LICENSING TREATED AS RESTRICTED PROCEEDINGS UNDER COMMISSION EX PARTE RULES On May 12, 1995, a Petition to Deny and Request for Stay was filed by the National Association of Black Owned Broadcasters, Percy Sutton, and the National Association for the Advancement of Colored People (collectively, "NABOB"). The Petition seeks denial of all applications for broadband PCS licenses in the A and B blocks. Also on May 12, 1995, NABOB filed an Application for Review and Request for Stay in connection with the Wireless Telecommunications Bureau's April 12, 1995 decision denying an earlier motion by Communications One, Inc. to stay licensing of the A and B blocks. (Order, PP Docket 93- 253, DA 95-806, adopted April 12, 1995) ("COI Order"). Finally, on May 12, 1995, Communications One and GO Communications Corporation jointly filed a Petition for Reconsideration of the COI Order. Under the Commission's rules, the NABOB Petition to Deny makes the A and B block licensing proceedings restricted proceedings in which ex parte communications are prohibited. 47 C.F.R.  1.1208. Because the issues raised in the other pleadings referenced above are sufficiently interrelated with those raised by the NABOB Petition, all these proceedings will also be treated as restricted. Accordingly, the Bureau will treat the NABOB Petition to Deny and Request for Stay, the NABOB Application for Review and Request for Stay, and the COI/GO Petition for Reconsideration as restricted proceedings. Therefore, effective as of the date of this Notice, under Sections 1.1202(b) and 1.1208, no written presentations relating to the merits or outcome of any of these pleadings may be made unless served on all of the petitioners, all A and B block auction winners, and all parties who have filed formal pleadings in the A and B block licensing proceedings, the COI Order proceeding, or the COI Order reconsideration. Similarly, effective as of the date of this Notice, no oral presentations may be made unless advance notice and an opportunity to be present is provided to all of the above-listed parties. 47 C.F.R.  1.1202(b) & 1.1208.
