March 13, 1995 COMMERCIAL MOBILE RADIO SERVICE INFORMATION ANNOUNCING THE WINNING BIDDERS IN THE FCC'S AUCTION OF 99 LICENSES TO PROVIDE BROADBAND PCS IN MAJOR TRADING AREAS; DOWN PAYMENTS DUE MARCH 20, 1995 On March 13, 1995, the Commission completed its auction of 99 licenses to provide Personal Communications Services in the 2 GHz band (broadband PCS), raising a total of $7,736,020,384. The winning bidders and the licenses each winning bidder has won are listed in Attachment A hereto. This attachment also lists the amounts that Omnipoint Corporation, Cox Communications, Inc., and American Personal Communications, L.P., will be required to pay for their licenses under the pioneer's preference program. Each winning bidder must submit to the Commission's lock-box bank sufficient additional funds to bring its total deposits with the government to twenty (20) percent of the sum of its winning bids by Monday, March 20, 1995. All payments must be made in U.S. dollars, must be in the form of a wire transfer or cashier's check, and must be made payable to the "Federal Communications Commission" or "FCC." No other form of payment will be accepted. Cashier's checks must be drawn on a financial institution whose deposits are insured by the Federal Deposit Insurance Corporation (FDIC). All payments, whether by wire transfer or cashier's check, must be made to the Mellon Bank in Pittsburgh, Pennsylvania. Payments made by cashier's check must be received by 11:59 pm Eastern Time, Monday, March 20, 1995. Payments made by wire transfer must be received by 6:00 pm Eastern Time, Monday, March 20, 1995. Bidders making payments by wire transfer should allow sufficient time for the wire transfer to be initiated and for the transmission to be completed prior to the deadline. Down payments must be accompanied by a completed FCC Remittance Advice (FCC Form 159). Bidders making payments by wire transfer must fax a completed FCC Form 159 to Mellon Bank at (412) 236-5702 at least one hour prior to placing the order for the wire transfer (but on the same business day). Additional instructions for making auction payments are contained in the Procedures, Terms and Conditions for this auction, which were included in the Bidder's Information Package. Winning bidders must specify each license won as a separate item on FCC Form 159 (use continuation sheet (FCC Form 159-C) if necessary). Bidders should include the "License No." designation(s) for each license (which are included in the attachment hereto) in Block 18 (FCC Code 2) of FCC Form 159. A bidder that has won multiple licenses must calculate the down payment applicable to each license separately by applying a portion of its upfront payment to each of the licenses won prorated on the basis of the amount of each winning bid relative to the sum of its winning bids. A sample FCC Form 159 showing the proration method to be used to calculate proper down payment amounts was included in the Bidder's Information Package for this auction. (Note: The sample FCC Form 159 does not include the required License No. designations in block 18.) Winning bidders who do not submit the required down payment by the specified deadline will be considered in default. An entity in default will be assessed a penalty equal to the difference between its winning bid and the winning bid the next time the license is offered by the Commission. An additional penalty equal to three percent of the lesser of the subsequent winning bid or the defaulting bidder's winning bid will also be assessed. See Section 24.704 of the Commission's Rules, 47 C.F.R.  24.704. Winning bidders also must timely submit a properly completed FCC application for a broadband PCS license (FCC Form 600) within ten (10) business days after issuance of a Public Notice to be released shortly that will include detailed instructions on filing the FCC Form 600. Once a winning bidder has submitted its down payment and filed the FCC Form 600 long-form application, the Commission will conduct a preliminary review of the application. If it is acceptable, the Commission will release a Public Notice announcing the acceptance for filing of the FCC Form 600. The release of this Public Notice will mark the start of a 30-day period during which interested parties will have the opportunity to file petitions challenging the winning bidder's qualifications to become a licensee. The acceptance of an application for filing does not preclude subsequent return, dismissal or denial of that application. After a detailed review of a winning bidder's FCC Form 600 application and any petitions filed against it, the FCC will determine whether there exist any reasons why the license should not be granted; if there are none, it will grant the license. Each grantee will be required to pay the remainder of its winning bid amount within five (5) business days after grant of the license. All license grants will be conditioned on full and timely payment of the bid price.
