These pleadings were put on Public Notice on July 11, 1996 (DA 96- 1063). Because these pleadings were formally opposed, pursuant to Section 1.1208(c)(1)(ii)(D) of the Commission's Rules, 47 C.F.R.  1.1208(c)(1)(ii)(D), they are restricted proceedings. On July 29, 1996, East River filed an Application for Review of the staff denial of East River's application for Specialized Mobile Radio (SMR) licenses (FCC File Nos. 654526, 654535, 654521, 65422, 654527, 654528, 654529, 654530, 654531, 654524, 654537, 654534, 654532). Because this pleading was unopposed, it has been exempt from ex parte requirements under Section 1.1204(a)(1)(i) of the Commission's Rules, 47 C.F.R.  1.1204(a)(1)(i). The above proceedings are closely interrelated due to the fact that the merits of East River's Application for Review are closely tied to those of its pending Waiver Requests. In order to avoid possible confusion and uncertainty on the part of the public and the parties of record regarding the application of the Commission's ex parte rules, East River's Application for Review will, effective upon release of this Public Notice, also be deemed restricted for ex parte purposes. Therefore, any written presentations regarding any of the above pleadings shall be served on the parties of record to these proceedings. In addition, no oral presentations regarding any of the above proceedings shall be made without notice to all the parties to these proceedings and an opportunity for them to be present. This action is taken pursuant to Section 1.1200(a) of the Commission's Rules, 47 C.F.R.  1.1200(a), which permits the Commission, in its discretion, to adopt modified or more stringent ex parteprocedures in particular proceedings if the public interest so requires.
