WASHINGTON, D.C. 20554 DA 97-1552 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov Released: July 21, 1997 FCC ANNOUNCES THE GRANT OF WIRELESS COMMUNICATIONS SERVICE ("WCS") LICENSES Balance of Winning Bids are due by August 4, 1997 Auction Event No. 14 On April 25, 1997, the Federal Communications Commission (Commission) completed its auction of 128 licenses of the Wireless Communications Service (WCS) in the 2.3 GHz band. On June 16, 1997, after a preliminary review of the FCC long form applications (Form 600), the Commission accepted for filing the applications for 52 Major Economic Areas (MEAs) authorizing service on 10 MHz of spectrum in Frequency Blocks "A" and "B" and 12 Regional Economic Area Groupings (REAGs) authorizing service on 5 MHz of spectrum in Frequency Blocks "C" and "D." Today, the Wireless Telecommunications Bureau, under delegated authority, conditionally grants the applications listed in Attachment A. The grants are conditioned upon full and timely payment of the remaining balance of the applicant's winning bid(s) within 10 business days of the date of this Public Notice (i.e., by August 4, 1997). See 47 C.F.R.  27.208(a), 1.2109(a). Applicants who do not submit the required payment by the specified deadline of August 4, 1997, will be considered in default and are subject to automatic license cancellation and additional default payments. See 47 C.F.R.  27.208(b). Specifically, an entity in default will be assessed a default payment equal to the difference between its winning bid and the amount of the winning bid the next time the license is offered by the Commission. See 47 C.F.R.  27.203(b). An additional default payment equal to three (3) percent of the lesser of the subsequent winning bid or the defaulting applicant s winning bid will also be assessed. Id. Individual License Grants Each applicant will receive its individual WCS license(s) following payment of the balance of its winning bid(s). Payment Instructions All applicants identified herein must submit to Mellon Bank the balance of their winning bids in a lump sum payment by August 4, 1997. All payments must be made in U.S. currency, and must be made in the form of a wire transfer. See 47 C.F.R.  1.2107(b). Wire transfer payments must be received by 6:00 p.m. Eastern Time, August 4, 1997. Applicants should allow sufficient time for the wire transfer to be initiated and for the transmission to be completed prior to the deadline. No personal checks, cashiers checks or other forms of payment will be accepted. Payments must be accompanied by a completed FCC Remittance Advice Form (FCC Form 159). ON THE FCC FORM 159, APPLICANTS MUST USE THE SAME FCC ACCOUNT NUMBER ASSOCIATED WITH THEIR FCC FORM 175. Applicants making payments must fax a completed FCC Form 159 to Mellon Bank at (412) 236-5702 at least one hour prior to placing the order for the wire transfer (but on the same business day).
