WASHINGTON, D.C. 20554 DA 97-2056 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov Released: September 23, 1997 COMMERCIAL MOBILE RADIO SERVICE YEAR-END TRANSFER AND ASSIGNMENT APPLICATIONS The Commercial Wireless Division (CWD) of the Wireless Telecommunications Bureau typically receives a large number of Commercial Mobile Radio Service (CMRS) transfer and assignment applications filed towards the end of each calendar year from applicants who wish to have such applications processed by year's end. To serve the public rapidly and efficiently, we are issuing this Public Notice to remind interested parties of our procedures for processing transfer and assignment applications. Pro Forma and non-pro forma transfer and assignment applications will be handled on two different processing tracks. In the normal course, a pro forma transfer or assignment will be processed within 30 days of the filing date; a non-pro forma transfer or assignment application will be processed within 75 days of the filing date if no petitions regarding the application are filed. Given the time it normally takes to process such applications, we recommend that any parties seeking approval of non-pro forma transfers or assignments before the end of the calendar year file these applications with the Commission no later than October 15, 1997. We recommend pro forma transfers or assignments be filed by November 10, 1997. However, CWD needs additional time to process CMRS applications which are subject to the Unjust Enrichment provisions of 47 C.F.R.  1.2111 because CWD must coordinate the approval of loan documentation with the parties to the application and the U. S. Treasury. We recommend filing CMRS applications which are subject to the Unjust Enrichment provisions by October 1, 1997. A Public Notice listing all transfer and assignment applications accepted for filing each week will be issued by the CWD Policy and Rules Branch every Friday. We will make every effort to process assignment and transfer applications filed by the above dates by the end of the year. In those instances in which expedited treatment is requested, the applicants must make a sufficient showing justifying the expedited treatment. Questions concerning the status of pending applications should be directed to Bobby Brown in the Policy and Rules Branch. In addition, entities contemplating the filing of a large number of transfer or assignment applications or filing applications that are subject to the Unjust Enrichment provisions are encouraged to contact Bobby Brown in advance of filing and provide the following information: type of filing (pro forma/non-pro forma), the number of call signs/facilities affected, number of applications, anticipated filing date, anticipated closing date and confirmation of loan payment status (if applicable).
