On  S- d(#.February6, 1995, the Commission released the LMS Report and Order* yO- v ]ԍ In re Amendment of Part 90 of the Commission's Rules to Adopt Regulations for Automatic Vehicle  {O-Monitoring Systems, Report and Order, PR Docket 9361, 10 FCC Rcd. 4695 (1995) (LMS Report and Order).* in which the Commission, inter  S- d(#alia, allocated bands for multilateration and nonmultilateration operations. The 904.000909.750 and  d(#921.750927.250 MHz subbands (Bands B and E, respectively) were allocated for multilateration  S- d(#-systems," {O- v ԍId. at 4722,  48. Multilateration systems use spreadspectrum technology to locate moving objects, such as vehicles, throughout a wide geographic area. while the 902.000904.000 and 909.750919.750 MHz subbands (Bands A and C, respectively)  S- d(#were allocated to nonmultilateration systems.| {O- v yԍId. Typically, nonmultilateration systems use narrowband technology to transmit data to and from vehicles passing through a specific location. Band D, comprised of the 919.750921.750 MHz sub S- d(#band, is licensed on a coequal basis by both multilateration and nonmultilateration systems.: {O,-ԍId.: In the LMS  S- d(#Report and Order, we concluded that sharing between multilateration and nonmultilateration systems is,  SR- d(#for the most part, inadvisable from a technical and regulatory standpoint.LRh  {OZ!-ԍId. at 4731,  70.L As a result, we authorized non S- d(#multilateration systems to operate only in the 902904 MHz and 909.75921.75 MHz subbands,cZ  {O#- v ԍ47 C.F.R.  90.353(h), 90.357(b). Nonmultilateration  d(#licensees have typically become aware of the conversion deadline only after they have attempted to renew,,,e@d;[!,L?? '#  h   d(#their existing authorizations and have been specifically advised by Commission staff through the application return process of the deadline.  v Because of the large number of nonmultilateration entities who were and are unaware that they  d(#are adversely affected by the conversion requirement as well as the low power at which nonmultilateration  d(#systems operate and the low likelihood that such systems will cause harmful interference, we believe that  d(#it is in the public interest to grant a limited waiver of the conversion deadline in order to allow non d(#multilateration entities to convert their systems to operate at the appropriate frequencies. We believe that  d(#granting a limited waiver of the conversion deadline for nonmultilateration facilities will prevent disruption to operations serving the public and result in little or no interference to neighboring licensees.  v !We continue to believe, however, that it is inadvisable for multilateration and nonmultilateration  d(#systems, other than those operating in the 919.75921.75 MHz subband, to operate in the same subband.  d(#zFurther, because the multilateration LMS bands are subject to competitive bidding, we believe that all  d(#LMS systems must finish conversion of their systems in order to enable prospective bidders to adequately  S - d(#evaluate the likely value of the licenses upon which they will be bidding.L K {Ok-ԍId. at 4729,  64.L Accordingly, conversion of  d(#nonmultilateration systems must be completed prior to the LMS auction, which is tentatively set for the  d(#zthird quarter of 1998. The spectrum conversion deadline for nonmultilateration operations is hereby  Sj- d(#"extended to September 1, 1998. ( jZK yOd- ԍOn February 18, 1998, Mark IV Transportation Products Group (Mark IV) filed an application for   modification of authority to operate a Parking Revenue Control System for Pittsburgh International Airport in which   Lit requested an extension of the spectrum conversion deadline. Mark IV also filed a request for waiver of the   spectrum conversion deadline regarding its nonmultilateration Intelligent Transportation Systems tag reader facility   at the Tampa International Airport in Tampa, Florida, on March 20, 1998. In its waiver request, Mark IV requested   that the Tampa facility be granted a waiver of the conversion deadline for the useful life of its equipment or until   June 1, 2005, whichever occurs first. Mark IV subsequently modified its waiver request on May 5, 1998, and asked   that a temporary waiver be granted until September 1, 1998, in order for it to convert its equipment at the Tampa   International Airport. Further, OrlandoOrange County Expressway Authority (OOCEA) filed an application for a   modified authorization to operate an Automatic Vehicle Identification System on March5, 1998. In its application,   ;OOCEA also requested a temporary waiver of the spectrum conversion deadline until conversion of its facilities can   ;be completed. Because the Commission is granting a limited waiver of the spectrum conversion deadline to all nonmultilateration operations, the respective requests by MarkIV and OOCEA are also granted. Operations not converted by this date will be automatically cancelled  d(# and requests for waiver of the September 1, 1998, deadline will not be considered absent a  S-compelling reason.
