JOINT STATEMENT OF COMMISSIONERS

MIGNON CLYBURN AND MICHAEL O’RIELLY

ON THE WIRELINE COMPETITION BUREAU’S IMPLEMENTATION OF

100% OVERLAP RULE
Washington (July 29, 2015) -- “Today, we support the Bureau’s Public Notice to
implement the phase out of universal service support for rate-of-return carriers in service
areas fully served by a competitor that does not receive such subsidies. Providing
support to a carrier that is in essence using it to compete against an unsubsidized provider
is not the best use of our scarce federal universal service dollars, as it distorts the market,
fuels inefficiency, creates an un-level playing field and is not the intent of universal
service. While today’s action is a significant first step, we have more to do to address
wasteful or excessive spending that is an undue burden on all consumers that contribute
to the program. Further reforms are necessary to ensure we target finite universal service
funds to areas that will not have broadband without such support.”

STATEMENT OF COMMISSIONER MICHAEL O’RIELLY

ON THE AT&T/DIRECTV MERGER APPLICATION

WASHINGTON, July 23, 2015. — After reading the Order as prepared by Commission
staff, reviewing the voluminous record in the proceeding, and listening to interested
parties, I voted the item this afternoon. To be clear, this process shouldn’t have taken this
long, and we shouldn’t have been so cavalier with the Commission’s merger review “shot
clock,” but at least we have arrived at this final stage.

I will release a substantive statement at the conclusion of my colleagues’ review and final
consideration of the item.

STATEMENT OF COMMISSIONER JESSICA ROSENWORCEL

On the President’s ConnectHome Initiative

--
WASHINGTON, July 15, 2015 – Today, the White House launched ConnectHome, a
program that will increase broadband options for families and students in public and
assisted housing.
FCC Commissioner Jessica Rosenworcel made the following statement:
“I applaud the announcement of the ConnectHome initiative, which promises to help get
some of the most disconnected Americans and their kids online.
“Today approximately 7 in 10 teachers assign homework that requires Internet access.
Kids may be connected in the classroom, but if they are disconnected at home, getting
basic schoolwork done is hard. This Homework Gap is the cruelest part of our new digital
divide. We need to bridge this gap and fix this problem because our shared economic
future depends on it. The ConnectHome initiative is a step in the right direction.”

STATEMENT OF COMMISSIONER MICHAEL O’RIELLY

ON TerraCom/YourTel SETTLEMENT

WASHINGTON, July 09, 2015. — Today’s announcement of the TerraCom/YourTel
settlement highlights the problem of making policy through enforcement actions. I am
certain that attempts will be made to cite the Consent Decree as precedent for an entire
industry even though it was the product of company-specific negotiations. Other
interested parties had no opportunity to comment at any point in time on the substance of
the Commission’s claims or legal theories, but will now be forced to embrace the product
of a closed and slanted process that will be portrayed as consensus practices and rules.

STATEMENT ON PAYPAL USER AGREEMENT CHANGES

--
WASHINGTON, June 29, 2015 – Federal Communications Commission Enforcement Bureau
Chief Travis LeBlanc issued the following statement in relation to PayPal’s commitments to
improve their user agreement:
“I commend PayPal for taking steps to honor consumer choices to be free from unwanted calls
and texts. The changes to PayPal’s user agreement recognize that its customers are not required
to consent to unwanted robocalls or robotexts. It clarifies, rightly, that its customers must provide
prior express written consent before the company can call or text them with marketing, and that
these customers have a right to revoke their consent to receive robocalls or robotexts at any time.
These changes, along with PayPal’s commitments to improve its disclosures and make it easier
for consumers to express their calling preferences, are significant and welcome improvements.”
The FCC sent PayPal a letter on June 11, 2015, to clarify the company’s responsibilities under
the Telephone Consumer Protection Act: http://go.usa.gov/3vzdK

STATEMENT OF FCC COMMISSIONER AJIT PAI

on Proposal to Create More Loopholes for Abuse of Designated Entity Program
WASHINGTON, June 25, 2015—I am deeply disappointed that Chairman Wheeler is proposing
yet more loopholes to allow corporate giants to abuse the designated entity program. For instance, those
benefiting from taxpayer-funded discounts when buying spectrum should use that spectrum for the
public’s benefit–not just lease most or all of it to large carriers like AT&T and Verizon. Loopholes like
this might be good for big business and small arbitrageurs, but they certainly aren’t in the interest of the
American people, and they do nothing to further wireless competition.
