license for ITFS Channels C1-C4 at Montgomery, AL;
denied the competing application of Coffee County Board of
Education for ITFS Channels at Society Hill, AL.  (By
MO&O [FCC 94-166] adopted June 13 by the Commission)

ODESSA AND LOS YBANEZ, TX.  Proposed substituting
Channel 3001 for Channel 299C2  at Odessa, and modifying 
the permit of KADM-FM accordingly; proposed substituting
Channel 253C2 for Channel 300C2 at Los Ybanez, and
modifying the license of KYMI-FM accordingly; ordered
Israel Ybanez to show cause why the license of KYMI-FM
should not be modified.  Comments are due August 31,
replies September 18.  (MM Docket No. 94-72 by NPRM
and Order to Show Cause [DA 94-709] adopted June 23 by
the Acting Chief, Allocations Branch, Mass Media Bureau)

TYLER, TX.  Proposed substituting Channel 221C3 for
Channel 221A at Tyler and modifying the license of KDOK-
FM accordingly; ordered Freestone Broadcasting Company,
Inc., licensee of KEMM-FM, Fairfield, TX, to show cause
why its license should not be modified by substituting
Channel 256A for Channel 221A at Fairfield, and modifying
the license of KEMM-FM accordingly; and substituting
Channel 277A for Channel 221A at Commerce, TX, and
modifying the license of KEEM-FM to reflect the channel
change.   Comments are due August 31, replies September

BELL ATLANTIC TELEPHONE COMPANIES.  Denied
AT&T's petition to suspend and investigate Bell Atlantic's
Tariff FCC No. 1, Transmittal No. 654, which proposed to
make permanent the Primary Interexchange Carrier (PIC)
Switchback Option Service that it currently offers under a
trial program.  (By MO&O [DA 94-763] adopted July 6 by
the Chief, Tariff Division, Common Carrier Bureau)

CABLE & WIRELESS, INC., ET AL, V. AMERITECH
TELEPHONE OPERATING COMPANIES.  Granted
motion for partial dismissal and dismissed with prejudice
Cable & Wireless's, et al., complaint against Ameritech
seeking damages resulting from alleged violations of the
Commission's rate of return prescription for the period
January 1, 1989 through December 31, 1990.  (By Order

INSTRON CORPORATION V. AMERICAN
TELEPHONE AND TELEGRAPH COMPANY (AT&T)
AND PACIFIC BELL.  Granted motion and dismissed with
prejudice Instron's complaint against AT&T and Pacific Bell
alleging violation s of the Sections 201,202, and 320 of the
Communications Act.  (By Order [DA 94-741] adopted June
30 by the Chief,  Formal  Complaints and Investigations
Branch)

TEL-SAVE,  INC. V. AT&T.  Granted motion and
dismissed with prejudice Tel-Save's complaint against
AT&T alleging violations with respect to various tariff
offerings.  (By Order [DA 94-738] adopted June 30 by the
Chief, Formal Complaints and Investigations Branch)

TOTAL-TEL USA COMMUNICATIONS, INC.  V. NEW
YORK TELEPHONE COMPANY (NYT).  Granted motion
and dismissed with prejudice Total-Tel USA's alleging that
NYT violated the Communications Act by earning in excess
of the rate of return  for interstate access services prescribed
by the Commission for the period January 1, 1989 through
December 31, 1990.  (By Order [DA 94-744] adopted June
30 by the Chief, Formal Complaints and Investigations
Branch)













VACATION NETWORK, INC. (VNI). V. SPRINT
COMMUNICATIONS COMPANY, LIMITED
PARTNERSHIP.  Granted motion and dismissed with
prejudice VNI's complaint against Sprint alleging that Sprint
violated the Communications Act by attempting to collect
charges for unauthorized interstate and international calls
that were either originated or accepted at one of VNI's
payphone locations.  (By Order [DA 94-745] adopted June
30 by the Chief, Formal Complaints and Investigations)

DAN COMM PAGING.  Denied review and affirmed the
Common Carrier Bureau's dismissal of Dan Comm's
application for facilities in the Public Land Mobile Service
at Middletown, OH.   (By MO&O [FCC 94-160] adopted
June 13 by the Commission)
