FCC RESPONDS TO COURT JUDGMENT IN LELAND,
NC, FM PROCEEDING (Report No. MM-858, Mass

     In response to a Judgment of a federal appellate
court, the Commission has explained its reasons for
dismissing and returning as unacceptable for filing the
application of Leland Broadcasting Group,Inc., for a new
FM station at Leland, NC.

SOUTHWESTERN BELL TELEPHONE COMPANY
(SWBT).  Dismissed SWBT's request for partial stay  of an
Order issued by the Common Carrier Bureau's Tariff
Division on October 4 which declined to grant a waiver of
the requirements of the Virtual Collocation Order and the
TRP Order; directed SWBT to show cause within seven
days why it failed to comply with the Commission's and the
Bureau's orders.  (By MO&O & Order to Show Cause 
[DA 94-1221] adopted November 2 by the Chief, Common
Carrier Bureau)

ERRATUM to Order adopted by the Common Carrier
Bureau on October 7 issuing a waiver permitting price cap
regulated common carriers to treat the cost associated with
the regulatory fees paid pursuant to Section 9 of the
Communications Act as exogenous cost by making
appropriate adjustments to their price cap indexes.  The
effective date should have read January 15, 1995.   [DA 94-
