applicant for a new AM station on 680 kHz at Baltimore,
reconsideration of previous ruling affirming Review Board
decision that MVB was not financially qualified to be a

[FCC 95-22] adopted January 12 by the Commission)

HERMITAGE, MO.  Dismissed petition of KYOO
Broadcasting for allotment of Channel 226A at Hermitage.

LOCAL RATE ORDER.  Remanded to the Town of

NEGATIVE OPTION BILLING.  Found that Warner Cable
Communications operating in Milwaukee, WI, has not
violated the 1992 Cable Act and was not in violation of the
prohibition on negative option billing.  (By MO&O [DA 95-
60] adopted January 19 by the Chief, Cable Services
Bureau)

NEGATIVE OPTION BILLING.  Found that Comcast
Cablevision of Tallahassee, FL, has not, with respect to its
wire maintenance service plan,  violated the 1992 Cable Act
and was not in violation of the prohibition on negative
option billing.  (By MO&O [DA 95-61] adopted January 19
by the Chief, Cable Services Bureau)

LAKE CABLEVISION.  Rescinded certificationof Gwinnett
County, GA, to regulate basic cable rates, on request of
Lake Cablevision.  (By MO&O [DA 95-84] adopted January
19 by the Chief, Cable Services Bureau)

TEL-COM, INC.  Denied petition by Tel-Com, Inc.,
challenging certification of the West Virginia Cable
Television Advisory Board applicable to portions of Mingo
County, WV, and the City of Matewan, WV; terminated
automatic stay; ordered Tel-Com to file required rate
justifications.  (By MO&O [DA 95-85] adopted January 20
by the Chief, Cable Services Bureau) 

BELLSOUTH/IRS.  Stayed, pending Commission action on
BellSouth's petition for review, effective date of Bureau
order (DA 95-26) allowing the IRS to inspect and copy
certain FCC files pertaining to BellSouth and other LECS.
