Additional Release for Monday, May 22, 1995

NOVATO CABLE COMPANY. Remanded operator's
appeal of FCC Form 1200-based local rate order, holding
that, although a franchising authority can properly set rates
for a nonresponsive operator based on the best information
available the operator, setting an operator's installation rates
at zero, as the City did here, was not in accordance with
our rules and was therefore unreasonable. City of Novato,
California. (By Order [DA 95-1125] adopted May 18 by
Chief, Cable Services Bureau)

Released Tuesday, May 23, 1995

CENTURY NEW MEXICO CABLE CORP. SILVER
CITY, NM. Denied petition filed by Century New Mexico
Cable Corporation's, regarding the Town's inclusion of 100
percent of four employees' salaries into the regulated
equipment basket, and the Town's adjustment to Century's
converter failure rate. (By MO&O [DA 95-1134] adopted
May 19 by the Chief, Cable Services Bureau)

CENTURY SOUTHWEST CABLE TV BEVERLY HILLS,
CA. Granted extension of local rate stay order for Century
Southwest Cable Corp. in Beverly Hills, California until the
Commission releases a decision on Century's Application for
Review for both Beverly Hills and Los Angeles, California.
(By Order [DA 95-1135] adopted May 19 by the Chief,
Cable Services Bureau)

FALCON CABLE SYSTEMS OF SAN LUIS OBISPO,
CA. Denied appeal of local rate order, holding that
Falcon's initial maximum permitted rate for the basic service
tier was $14.17. That rate was in effect until the County
approved a rate increase in the subsequently filed Form
1210. Falcon did not file its Form 1210 until October 31,
1994. The County approved the increase in that filing,
effective December 1, 1994. For the period July 14, 1994
through November 30, 1994, the difference between $15.72,
the rate Falcon charged, and $14.17, Falcon's permitted
rate, constitutes Falcon's refund liability. Because the
County defined Falcon's refund liability in this manner in its
rate order, we find its decision reasonable. (By Order [DA
95-1136] adopted May 19 by the Chief, Cable Services
Bureau)

CABLEVISION INDUSTRIES. Granted petition for
revocation filed by Florida Cablevision Management, Corp.
d/b/a/ Cablevision Industries challenging the certification of
Collier County, Florida to regulate Cablevision Industries'
basic cable service rates. Cablevision Industries argues that
it is subject to effective competition under the low
penetration test. (By MO&O [DA 95-1137] adopted May
19 by Chief, Cable Services Bureau)
