OF U.S. COURT OF APPEALS FOR DISTRICT OF
COLUMBIA CIRCUIT AFFIRMING FCC DECISION
RECLAIMING DBS CHANNELS
     The U.S. Court of Appeals for the District of
Columbia Circuit issued an opinion affirming the October
1995 FCC decision reclaiming Direct Broadcast Satellite
orbital locations and channels previously allocated to
Advanced Communications Corporation (Advanced
Communications Corp. v. FCC.)

     In order to implement a new statutory provision of
the Telecommunications Act of 1996, the Commission has
adopted rules establishing a default dispute resolution
process for when technical disputes arise between a  non-
accredited standards development organization (NASDO) and
any party who funds the activities of the NASDO.

     The FCC's International Bureau today took another
step towards eliminating discriminatory behavior by foreign
monopolists against U.S. carriers and the distortion of
competition in the U.S. market caused by such conduct.
