Third Supplemental Protection Order: On November 18, 2011, the Federal Communications Commission (Commission) released the USF/ICC Transformation Order. In that Order, the Commission adopted a methodology for distributing universal service support under the newly created Connect America Fund Phase II in areas served by price cap carriers. The methodology will use a forward-looking cost model to estimate the costs of deployment of voice and broadband capable networks in high-cost areas and identify at a granular level the areas where support will be made available. The Commission delegated to the Wireline Competition Bureau (Bureau) “the task of selecting a specific engineering cost model and associated inputs” that meet the criteria specified in the USF/ICC Transformation Order.

Lifeline Program Savings Public Notice: In this report, the Wireline Competition Bureau (Bureau) provides an update on the implementation of the major reforms adopted by the Commission in the Lifeline Reform Order and the progress made towards the Commission’s $200 million savings target for 2012. The Bureau estimates that the reforms have already generated approximately $42.75 million in savings to the Universal Service Fund (Fund) thus far in 2012 compared to what would have been distributed to Eligible Telecommunications Carriers (ETCs) in the absence of reform. These savings were generated by continuing in-depth data validations (IDVs) to check for and eliminate duplicative Lifeline support, eliminating Link Up support on non-Tribal lands and on Tribal lands for Lifeline-only ETCs, and capping support for Toll Limitation Service (TLS). Based on these savings and anticipated savings in the second half of the year, the Bureau anticipates the reforms will yield at least $200 million in savings to the Fund for 2012.

Marana Unified School District Order: The Division denies appeals of USAC E-rate decisions filed by the Marana Unified School District (Marana) and its service provider, Trillion Partners, Inc. (Trillion), rescinding Marana’s funding commitments for funding years 2006-2010. Specifically, USAC rescinded funding for 12 of Marana’s funding requests as part of its funding year 2006, 2007, and 2008 applications and sought recovery for funding already disbursed for funding years 2007 and 2008 on the ground that Marana violated the Commission’s competitive bidding requirements. For the same reasons, USAC also denied funding for nine of Marana’s funding requests as part of its funding year 2009 and 2010 applications. Upon review of the record, we find that Marana violated the Commission’s competitive bidding requirements. We therefore deny Marana’s and Trillion’s appeals and affirm USAC’s decisions. We direct USAC to continue recovery actions against Marana and its service provider, Trillion, consistent with the order.

2011 Modification High Cost Universal Service Support Formulas Order: Each year, the Wireline Competition Bureau (Bureau) reviews and approves or modifies any proposed modifications to the formulas used to calculate universal service high-cost loop support (HCLS) and local switching support (LSS) for average schedule companies. Pursuant to section 69.606(b) of the Commission’s rules, the National Exchange Carrier Association, Inc. (NECA) files the annual average schedule company formula modifications for HCLS. Pursuant to section 54.301(f) of the Commission’s rules, the Universal Service Administrative Company (USAC) submits the proposed formula for LSS. The Commission’s rules require that these formulas “simulate the disbursements that would be received … by a company that is representative of average schedule companies.
