Appendices A through E list C block licensees that properly filed elections, filed defective elections, or did not file an election. Appendix F lists the spectrum being returned to the Commission by C block licensees under amnesty, disaggregation and the affordability exception to the prepayment option. All elections were effective on June 8, 1998 subject to the procedures described in the Second Report and Order, Order on Reconsideration and the Implementation Procedures Public Notice. PROPERLY FILED ELECTIONS Properly filed elections are listed in Appendix A. The elections are listed on a license-by-license basis and include the MTA, BTA, call sign, licensee name, and election. DEFECTIVE ELECTIONS Defective elections are divided into two categories: defective filings and conditional filings. Defective Filings: In accordance with the Implementation Procedures Public Notice, any C block licensee that made a defective election is considered to have elected to resume making payments under its original Notes(s) and is required to repay Suspension Interest in eight equal payments. Licensees that made defective filings are listed in Appendix B. Conditional Filings: A number of C block licensees filed elections subject to certain conditions. These filings are rejected as non-responsive and will not be processed in their present form. The Bureau will NOT accept conditional elections. However, the Bureau will allow those licensees listed in Appendix C, that filed timely elections with conditions, to file the same election they made on June 8, 1998 without conditions. NO OTHER CHANGES TO THE ELECTIONS MADE ON JUNE 8, 1998 WILL BE ACCEPTED. Resubmitted unconditional elections must be received by the Commission no later than June 23, 1998, 5:30 PM. These notices must be delivered to the Office of the Secretary, Federal Communications Commission, 1919 M Street, N.W., Washington, D.C. 20554. In addition, a copy of each unconditional Election Notice should be sent to (1) Wireless Telecommunications Bureau, Federal Communications Commission, 2025 M Street, N.W., Room 5002, Washington, D.C. 20554, and (2) Rachel Kazan, Federal Communications Commission, Wireless Telecommunications Bureau, Auctions and Industry Analysis Division, 2025 M Street, N.W., Room 5202, Washington, D.C. 20554. NO ELECTRONIC FILINGS WILL BE ACCEPTED. Failure to file the identical election without conditions by June 23, 1998, will result in a defective election. Furthermore, in accordance with the Implementation Procedures Public Notice, any C block licensee that makes a defective election will be considered to have elected to resume making payments under its original Notes(s) and will be required to repay Suspension Interest in eight equal payments. LICENSEES THAT DID NOT FILE AN ELECTION NOTICE In accordance with the Implementation Procedures Public Notice, any licensee that failed to file a timely Election Notice is treated as having elected to continue making payments under its existing Note obligations and is required to pay, by July 31, 1998, all unpaid interest accruing from the date of license grant through July 31, 1998. Licensees that did not file an Election Notice are listed in Appendix D. ELECTION FILINGS FROM NON-LICENSEES The Bureau received two filings from entities that are not C block licensees.
