On July 11, 2014, the FCC adopted a Second Order on Reconsideration and Second Further Notice of Proposed Rulemaking (Second FNPRM) addressing the captioning of video clips on the Internet.  For more information about this Second Order and Second FNPRM, please read the previous AccessInfo blurb that we posted about this proceeding:  http://transition.fcc.gov/cgb/dro/AccessInfo/2014-07 - 14c.pdf.

 

On August 6, 2014, the due dates were announced for public comments on the Second FNPRM: Due Date for Comments:  October 6, 2014

Due Date for Reply comments:  November 3, 2014

 

 

The issues in the Second FNPRM include the following:

  1. Whether third party distributors should be responsible for posting clips with captions on their websites and apps,
  2. Whether the delays for captioning live and near-live clips should be decreased or eliminated,
  3. Whether “mash-ups” clips should be covered (“mash-up” clips are clips that combine captioned TV programming with some uncaptioned Internet programming), and
  4. Whether the new rules should cover “advance” video clips. “Advance” video clips are those that are put online after the applicable compliance deadline but before the video

programming is shown on television with captions, and which then remain online after the captioned programming was shown on television.

 

The rules contain three separate compliance deadlines:  January 1, 2016, where the video clip contains a single excerpt of a captioned television program with the same video and audio that was presented on television (“straight lift” clips); January 1, 2017, where a single file contains multiple straight lift clips (“montages”); and July 1, 2017, for video clips of programming shown live or near- live on television.
