Dear Ms. Latif:
On November 8, 2012, New Cingular Wireless PCS, LLC (New Cingular) filed the above-
captioned application for a fixed-satellite service VSAT network license to operate several
models of remote terminals to connect temporary cell sites and mobile switching centers
throughout the United States. On January 11, 2013, New Cingular filed the above-captioned
amendment to reduce the requested transmit frequency range from 13.75-14.5 GHz to 14.0-14.5
GHz. For the reason stated below, we dismiss the portion of New Cingular’s application that
proposes to use 1.2-meter Raysat antennas with emission designator 3M00G7W, without
prejudice to refiling.1
Section 25.112 of the Commission’s rules, 47 C.F.R. § 25.112, requires the Commission to
return, as unacceptable for filing, any application that is not substantially complete, that contains
internal inconsistencies, or that does not substantially comply with the Commission’s rules.
New Cingular states in item E49 of Schedule B that the maximum EIRP density per carrier will
be 22.9 dBw/4kHz for emission designator 3M00G7W for the 1.2-meter Raysat antennas. Our
analysis indicates that the proposed input power into the antenna will be -7.10 dBW/4kHz,2 which
exceeds the maximum power density of -14dBW/4kHz for routinely authorized earth stations
specified in Section 25.212(c), 47 C.F.R. § 25.212(c). Consequently, pursuant to Section
25.212(e), 47 C.F.R. § 25.212(e), the procedures set forth in Section 25.220(d)(1), 47 C.F.R. §
25.220( d)(1), apply and New Cingular must submit the certifications listed in paragraphs
25.220(d)(1)(i) through (d)(1)(iv). New Cingular did not provide this documentation, and its
application is therefore incomplete.

Accordingly, pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R.
§ 25.112(a)(1), and Section 0.261 of the Commission’s rules on delegations of authority, 47
C.F.R. § 0.261, we dismiss, without prejudice to refiling, New Cingular’s application to use
1.2-meter Raysat antennas with emission designator 3M00G7W.
