Auction No. 32 offered three construction permits for new AM broadcast stations. These construction permits were the subject of pending, mutually exclusive short-form applications (FCC Form 175) and participation in this auction was limited to those applicants.

A complete listing of the construction permits for Auction No. 32 was provided in Attachment A of the Auction No. 32 Procedures Public Notice, DA 02-2623, released October 15, 2002.

AM Broadcast (AM) – A broadcast station licensed for the dissemination of radio communications intended to be received by the public and operated on a channel in the AM broadcast band.

The winning bidders are awarded construction permits, rather than a "license." Each original construction permit for the construction of a new AM station shall specify a period of three years from the date of issuance within which construction must be completed and application for license filed. (See 47 C.F.R. § 73.3598). Licenses are issued for an eight-year term. (See 47 C.F.R. § 73.1020(a))..

An applicant claiming that it qualifies for a 35 percent new entrant credit must certify under penalty of perjury that neither it nor any of its attributable interest holders have any attributable interests in any other media of mass communications, as defined in 47 C.F.R. § 73.5008. With respect to those applicants claiming a 25 percent credit, the applicant must provide a certification under penalty of perjury that neither it nor any of its attributable interest holders have attributable interests in more than three media of mass communications, as defined in 47 C.F.R. section 73.5008. In addition, applicants claiming a 25 percent credit shall identify and describe such media of mass communications. (See 47 C.F.R. §§ 73.5007 and 73.5008).

Potential bidders are reminded that they are solely responsible for investigating and evaluating all technical and market place factors, including any pending proceedings, that may have a bearing on the value of the AM broadcast facilities in this auction.
